Anot\u00e1cia:<\/strong><\/p>\n Sf\u00e9ra ochrany osobn\u00fdch \u00fadajov zamestnanca a s t\u00fdm s\u00favisiacich povinnost\u00ed zamestn\u00e1vate\u013ea je jednou z najdynamickej\u0161ie sa vyv\u00edjaj\u00facich oblast\u00ed pr\u00e1va. Pr\u00e1vo sa sna\u017e\u00ed reagova\u0165 na rozvoj technol\u00f3gi\u00ed umo\u017e\u0148uj\u00facich monitorovanie zamestnancov a zber d\u00e1t, pri\u010dom (tradi\u010dne) vo\u010di nim zaost\u00e1va. Mohutn\u00fd trend informatiz\u00e1cie zberu d\u00e1t spojen\u00fd s \u010doraz v\u00e4\u010d\u0161\u00edm z\u00e1sahom do s\u00fakromnej sf\u00e9ry zamestnanca (a niekedy i z\u00e1kazn\u00edka) v d\u00f4sledku ambici\u00f3znej snahy na \u00farovni Eur\u00f3pskej \u00fanie (prijat\u00edm nariadenia o ochrane osobn\u00fdch \u00fadajov) dostane z\u00e1kladn\u00e9 \u0161tandardy a mantinely, ktor\u00e9 bude musie\u0165 re\u0161pektova\u0165 ka\u017ed\u00fd jeden \u010dlensk\u00fd \u0161t\u00e1t. Tieto \u0161tandardy s\u00fa v\u0161ak v pr\u00e1vnych norm\u00e1ch pod\u00e1van\u00e9 typick\u00fdm zlo\u017eit\u00fdm pr\u00e1vnick\u00fdm jazykom, \u010dasto nepochopite\u013en\u00fdm pre oby\u010dajn\u00e9ho zamestn\u00e1vate\u013ea, pri\u010dom mno\u017estvo pr\u00e1vnych noriem vo vz\u0165ahu k ochrane osobn\u00fdch \u00fadajov obsiahnut\u00fdch v Z\u00e1konn\u00edku pr\u00e1ce, Ob\u010dianskom z\u00e1konn\u00edku ako i v z\u00e1kone o ochrane osobn\u00fdch \u00fadajov (po novom \u010doskoro i v nariaden\u00ed o ochrane osobn\u00fdch \u00fadajov) tejto nepreh\u013eadnosti nepom\u00f4\u017ee. Aj preto vn\u00edmame ako ve\u013emi \u017eiadan\u00fa pr\u00edpravu pr\u00e1vnej anal\u00fdzy, v ktorej spracujeme katal\u00f3g pr\u00e1v a povinnost\u00ed zamestn\u00e1vate\u013ea v s\u00favislosti s meniacou sa pr\u00e1vnou \u00fapravou a s n\u00edm koreluj\u00faci katal\u00f3g pr\u00e1v a povinnost\u00ed zamestnanca (ktor\u00fd bude reflektova\u0165 mnoh\u00e9 nov\u00e9 zav\u00e1dzan\u00e9 in\u0161tit\u00faty podporuj\u00face ochranu osobnosti – napr. pr\u00e1vo by\u0165 zabudnut\u00fd, pr\u00e1vo na obmedzenie zberu d\u00e1t a pod). Ke\u010f\u017ee mo\u017enosti monitorovania maj\u00fa ve\u013emi tenk\u00e9 a nejasn\u00e9 hranice, definovan\u00e9 mnohokr\u00e1t len \u00fa\u010delom zberu d\u00e1t, pok\u00fasime sa z\u00e1rove\u0148 v pr\u00e1vnej anal\u00fdze pripravi\u0165 rie\u0161enia na mno\u017estvo praktick\u00fdch situ\u00e1ci\u00ed, s ktor\u00fdmi sa zamestn\u00e1vatelia stret\u00e1vaj\u00fa na dennom poriadku.<\/font><\/span><\/p>\n Annotation:<\/font><\/span><\/strong><\/p>\n The sphere of privacy of the employees and related obligations of the employers is one of the most dynamically developing areas of law. It is because of the fact that the law seeks to respond to the development of technologies that allow employee monitoring and data collection, and (traditionally) stays behind that development. This trend of informatization of data collection coupled with an increasing interference to the private sector of employees (and sometimes even the customers) receive an ambitious effort at European Union level (the adoption of The Regulation of Protection of Personal Data) and will set up basic standards and constraints that will have to respect each and every Member State . These standards are administered in legal norms in typical specific legal language, often incomprehensible for ordinary employer, and because the rules of the protection of personal data is now operating in synergy of the Labour Code, the Civil Code as well as the Act on Protection of Personal Data (after the efficiency it will be the new Regulation on the Protection of Personal Data and new Act on Protection of Personal Data) this lack of transparency does not help. That is why we see such high demand for preparation of legal analysis, in which will be processed the catalog of rights and obligations of the employer in regard to changing legislation, as well as the catalog of employee obligations and rights (as it introduces many new institutes that support the personality protection – e.g. the right to be forgotten).
